NDA Market Engagement Announcement

Following the Government's support in the Energy White Paper of a new nuclear generation programme, the NDA announced on 11 January 2008 its intention to invite proposals which meet its strategic objectives and maximise value for the UK taxpayer.
In recognition of the current market interest the NDA is now starting a process to gauge the interest of parties wishing to use NDA land, the fuel manufacturing business at Springfields and its Uranic material. Details of our sites, plants and materials can be found on this website.
Interested parties should write to the NDA stating which assets and activities they have an interest in, whether if more than one asset they see benefits in a combination of assets and the benefits which would result for the NDA.
Where the use includes new nuclear build parties should be aware that this process does not replace the Strategic Siting Assessment which is proposed by the Government to commence in Spring 2008.
Parties wishing to express market interest should respond with the information requested above by 3 April 2008. The NDA will then consider any such responses before determining the competition process going forward.
The NDA is also continuing the process of consulting with stakeholders and its local communities through the site end state consultation initiated in 2006.

The information listed above (the "Information") is being disclosed by the Nuclear Decommissioning Authority (the "NDA") in connection with the announcement made on 6th March 2008 concerning possible use of NDA land, the fuel manufacturing business at Springfields and Uranic material (together the "Assets"). The issue of this information memorandum shall not be deemed to be any form of commitment on the part of the NDA to proceed with any transaction relating to the use of all or any of the Assets.
All responses proposals and submissions made to the NDA in relation to the Information and/or in connection with the Process are made at the risk of the interested party concerned. Neither the NDA nor any of its advisers shall be liable for any costs or expenses incurred by any interested party or any other person who may access the Information in connection with the Process.
The Information may not be reproduced, copied or stored in any medium, in whole or in part, without the prior written consent of the NDA, other than as strictly required for the preparation of a response to the Process. All intellectual property rights in the Information, and the information contained or referred to in it, shall remain the property of the NDA and its licensors and no interested part shall obtain any right, title or interest therein.
The NDA is subject to the application of the Freedom of Information Act 2000 and as such may be obliged to disclose information it holds (including but not limited to any responses received from interested parties in connection with the Process) in response to requests for information, subject to any relevant exemptions. Further, the NDA may be required to disclose certain information in relation to the Process (including but not limited to any responses received from interested parties in connection with the Process) to relevant public authorities and also to a court in the course of legal proceedings or to any regulatory body in connection with the discharge of its functions.
The above terms shall not exclude any liability for, or remedy in respect of, fraudulent misrepresentation.
Under no circumstances should any interested party approach or enter into discussions with any director, officer or employee of the NDA in connection with the Information or the Process.
